General Terms and Conditions (GTC)

§ 1 Scope of Application

These General Terms and Conditions apply to all orders placed through the online shop https://todayisthedeepest.myshopify.com between

and its customers.

Deviating conditions of the customer are not recognized, unless their validity has been expressly agreed to.

§ 2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an unbinding invitation to place an order.

By clicking the order button, the customer places a binding order for the goods contained in the shopping cart.

The purchase contract is concluded only with the shipping confirmation or delivery of the goods.

§ 3 Limited Editions ("Drops")

New products are regularly released in limited quantities. A claim to delivery exists only upon successful order and as long as supplies last.

Products from previous drops may still be offered, provided there are remaining stocks. The display of older collections in the archive is for informational purposes only.

Registration on waiting lists does not establish a claim to delivery or purchase. Notifications of re-availability are made voluntarily.

§ 4 Prices and Payment Terms

All prices stated are final prices and include statutory VAT.

Additional shipping costs are explicitly stated during the ordering process.

The following payment methods are available:

• PayPal

• SEPA direct debit

• Apple Pay

• Google Pay

• Vouchers and gift cards

Payment processing is carried out by the respective payment service providers offered.

§ 5 Delivery

Delivery takes place within Germany, unless otherwise agreed in individual cases.

Delivery times are non-binding estimates. In the event of delivery delays due to force majeure or other unforeseen events, the delivery period will be extended accordingly.

Obvious transport damages should be reported as soon as possible. The customer's legal rights remain unaffected by this.

§ 6 Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details can be found in the explicit cancellation policy.

In the event of withdrawal, the customer bears the direct costs of returning the goods, unless otherwise agreed.

Custom-made products are excluded from exchange.

§ 7 Vouchers and Promotional Codes

Gift vouchers are not redeemable for cash.

Promotional codes cannot be combined with other discounts, unless otherwise stated.

The Seller reserves the right to deactivate promotional codes for important reasons.

§ 8 Retention of Title

The goods remain the property of the Seller until full payment has been received.

§ 9 Warranty and Liability

The statutory warranty rights apply.

The Seller shall be liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health.

In the event of slightly negligent breaches of essential contractual obligations, liability is limited to typical, foreseeable damage.

Otherwise, liability is excluded to the extent permitted by law.

§ 10 Data Protection

The processing of personal data takes place in accordance with the separate privacy policy. (GDPR)

§ 11 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the Seller's registered office.

§ 12 Final Provisions

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
